Allgemeine Geschäftsbedingungen (AGB)

for attending on-site events at the Fraunhofer Institute for Laser Technology ILT

 

1. subject matter; contractual partners

1.1 The Fraunhofer Institute for Laser Technology ILT (hereinafter: Fraunhofer ILT) is the host and organizer of various public and non-public events (hereinafter: events).

1.2 Fraunhofer ILT is a legally dependent institution of the Fraunhofer-Gesellschaft zur Förderung der angewandten Forschung e.V., Hansastraße 27c, 80686 München e.V., represented by the Executive Board, Prof. Dr.-Ing. Holger Hanselka and Prof. Dr. Constantin Häfner, Registry court: Munich District Court, Register of Associations No. VR 4461 (hereinafter referred to as “Fraunhofer”). All rights and obligations arising from these General Terms and Conditions shall therefore be towards Fraunhofer.

1.4 The following provisions shall apply to contracts for participation in events. Any pre-formulated terms and conditions of the contracting party that are different, contrary or supplementary shall not become part of the contract unless Fraunhofer ILT expressly agrees to their validity.

 

2. registration; conclusion of contract

2.1 Registration for the LKH2 - Laser Colloquium Hydrogen 2025 is done online using the registration form that can be found on the website www.ilt.fraunhofer.de/lkh2. Registration is only possible until September 1, 2025. Please note that participation in the LKH2 - Laser Colloquium Hydrogen is not possible without booking the evening event.

2.2 Online registration is a binding offer to participate in the event. After completing the online registration, Fraunhofer ILT will send an electronic confirmation of receipt of the registration to the e-mail address you provided during registration. This information does not yet constitute an acceptance of the contract. A contract for participation in the event is only concluded upon explicit confirmation of participation by Fraunhofer ILT, which Fraunhofer ILT will send you by e-mail together with an invoice for the participation fee.

2.3. The access authorization for the event is not transferable to third parties. In justified exceptional cases, Fraunhofer ILT may agree to the transfer of the access authorization. However, you have no right to this.

 

3. contents of the event

3.1 The topics of the event can be found in the program, which can be accessed on the website www.ilt.fraunhofer.de/lkh2 within the event announcement.

3.2 Fraunhofer ILT reserves the right to make changes to the program schedule or program content. Such changes do not entitle the participant to a reduction in the participation fee. Fraunhofer ILT will endeavor to announce any changes to the program schedule or program content in a timely manner.

 

4. Participation fee; payments

4.1 The participation fee includes the conference documents, lunch or a snack and coffee breaks on the days of the event. The amount of the participation fee and the costs for additional offers not included in the participation fee (e.g. evening events) can be found in the description of the event, which can be accessed on the website www.ilt.fraunhofer.de/lkh2.

4.2 The participation fee shall be paid exclusively by bank transfer. When paying by bank transfer, the invoice number, your name and the keyword “LKH2-2025-Fraunhofer ILT” must be provided.

4.3 Payments shall be made in euros. Any bank transaction fees incurred in the processing of the payment transaction shall be borne by you.

4.4 Payment of the participation fee shall be due within 14 days of receipt of the invoice in accordance with Section 2.2 of these Terms and Conditions of Participation and shall be made without any deductions. The date of receipt of payment in the account of Fraunhofer ILT shall be decisive. Partial payments are not possible.

 

5. Right of withdrawal for your registration for the event

If you are a consumer, you have a statutory right of withdrawal, which is explained below. A consumer is a person who enters into a transaction for a purpose that can be attributed neither to his commercial nor his self-employed professional activity (Section 13 of the German Civil Code (BGB)).

Right of withdrawal / Cancellation policy
You have the right to revoke this contract within fourteen days without stating any reasons.

The revocation period shall be fourteen days with effect from the date of the conclusion of the contract.

To exercise your right of revocation, you must inform us,

by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You may use the attached sample withdrawal form for this purpose, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.


Consequences of revocation

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you have requested that the services commence during the revocation period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided by the time you notify us of the exercise of the right of revocation with respect to this contract, compared to the total scope of the services provided for in the contract.

6. cancellation of registration; cancellation by the organizer; withdrawal of the organizer

6.1. For cancellations received by August 1, 2023, the participation fee will be refunded minus a processing fee of 100 euros. For cancellations received after August 1, 2023, the participation fee will be charged in full.

6.2. Cancellations must be made in writing and addressed exclusively to seminare@ilt.fraunhofer.de.

6.3 If the event is canceled, no attendance fee is to be paid. Payments already made will be refunded.

6.4 Fraunhofer ILT is entitled to withdraw from the contract for participation in the event without the need for a reminder and setting of a deadline if the attendance fee is not paid within the period specified in Section 4.4.
 

7. pictures from the event; portraits of participants

7.1 You may produce and use image material (e.g. photographs, film recordings) of the event for private purposes only. Any commercial use of the image material shall require the prior express written consent of Fraunhofer ILT.

7.2 During the event, Fraunhofer ILT shall be entitled to produce image material on which participants may be depicted and to use and publish such image material for purposes of documentation, for accompanying or subsequent reporting, and for follow-up advertising for this event, as well as for public relations work, or to make such image material available to third parties (e.g. the press) for the aforementioned purposes.

 

8. Liability

8.1. Unlimited liability: Fraunhofer is liable for intent and gross negligence. Fraunhofer is liable for slight negligence in accordance with the Product Liability Act, as well as for damages resulting from injury to life, limb or health of persons.

8.2. Limitation of liability: Fraunhofer is otherwise only liable for slight negligence in the event of a breach of a material contractual obligation, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligation), and limited in amount to the damages foreseeable at the time of the conclusion of the contract and typical for the contract.

8.3 This limitation of liability also applies in favor of the vicarious agents of Fraunhofer.

9. Copyright and rights of use

The materials obtained during the event are protected by copyright. Any distribution, exhibition, making publicly available, public reproduction and duplication – except for acts of duplication for exclusively private purposes within the meaning of § 53 UrhG – is only permitted with the express consent of Fraunhofer ILT.
 

10. data protection

The organizer processes personal data collected in connection with registration and participation in the event in accordance with the applicable data protection regulations. Further information, in particular on the purposes and scope of the processing, as well as the rights of the persons concerned, can be found in the organizer's data protection information, which is referred to when registering for the event.

 

11. Final provisions

10.1 Should one or more provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall not be affected.

11.2 Amendments or supplements to these General Terms and Conditions must be made in writing. This also applies to the amendment of the written form requirement.

11.3 All claims arising out of or in connection with this contractual relationship shall be governed by German law, excluding the provisions of the United Nations Convention and Contracts for the International Sales of Goods (CISG), the so-called UN Sales Convention.

11.4 If the contracting party is a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, the City of Munich shall be the exclusive place of jurisdiction for all disputes arising out of or in connection with contracts between Fraunhofer and the contracting party.

NOTE

Insofar as the fulfillment of contractual obligations of the Fraunhofer ILT requires a license due to national, European, US or international regulations of foreign trade law including embargoes (and/or other sanctions), the fulfillment of the contract is subject to the granting of a license by the relevant authorities; if a license is not granted, the Fraunhofer ILT is not in breach of contract or duty. The same shall apply if the fulfillment of the contract should be prohibited due to the aforementioned regulations.

Fraunhofer ILT shall not be liable for damages due to delays or impediments to performance with regard to national, European, US or international foreign trade and payments law including embargoes (and/or other sanctions). The same applies to other claims (such as repayment or warranty claims based on advance payment guarantees or advance payment bonds, etc.).

If the customer is entitled in individual cases under the contractual provisions to also grant licenses for the research and development results outside of Germany, the customer shall comply with all national, European, US or international foreign trade and payments law provisions, including embargoes (and/or other sanctions).
